ECMAT and FSD Ethiopia Publish Draft Capital Market Guidebook for Legal Professionals

The Ethiopian Capital Market Administrative Tribunal (ECMAT), in collaboration with FSD Ethiopia has completed the first draft of a book entitled “Capital Market Guidebook for Judges and Lawyers” which is intended to serve judges and legal professionals.
This draft book, consists of 279 pages, provides detailed explanations of general concepts of the capital market, as well as the roles and functions of capital market participants, market makers, collective investment scheme operators, and other service providers operating in the market.
In addition, the draft addresses who an investor is, investor protection, prohibited practices within the trading system, the types of sanctions applicable when market participants engage in prohibited activities, and the economic harm caused by such prohibited practices. These issues are discussed alongside comparative experiences drawn from other countries.
The guidebook also outlines alternative dispute resolution mechanisms within the capital market ecosystem, as well as the mandate, powers, responsibilities of the ECMAT and its expected role within the trading system as well as its integration with regular courts.
