Your frequently asked questions

Could you explain what the Ethiopian Capital Market Administrative Tribunal is?

The Ethiopian Capital Market Administrative Tribunal is an independent specialized tribunal established under Article 64 of Ethiopian Capital Market Proclamation No. 1248/2021. Its primary role is to hear and decide appeals arising from decisions of the Ethiopian Capital Market Authority or a person who exercises the power and duties of the authority, ensuring efficient, impartial, and expert resolution of capital market disputes.

What is the reason behind the need to adjudicate capital market dispute by a specialized tribunal rather than regular courts?

The tribunal was established to ensure timely, efficient, and predictable resolution of capital market disputes. Regular courts often face procedural rigidity and heavy caseloads, which are unsuitable for capital market disputes where time value of money and market confidence are critical.

Does the Tribunal have the power to enforce its decisions?

Yes. The Tribunal has the same enforcement powers as regular courts set under the Ethiopian Civil Procedure Code. It can issue summonses, compel witnesses, order document production, issue injunctions, and request police assistance to enforce its decisions.
